Description of Event/Crime : On 09/07/2011 at 0300 hours Officers with
the Foothills Area Command responded to an apartment complex located at
901 Tramway Blvd. Ne in reference to a male subject who had been shot.
Upon arrival Officers contacted the victim, Marcus Chestnut, who had
suffered a gun shot wound to the leg. Marcus Chestnut advised officers
that he had been shot by a Hispanic male in a vehicle. Marcus was very
uncooperative with Officers on scene, stating he did not want to
prosecute the offender.
Throughout the day Detectives with the Foothills IMPACT team
followed leads based on other versions Marcus had relayed to members of
his family. At one point Marcus had told family that he had committed a
Robbery and Kidnapping and had been shot during the commission of that
crime. Detectives followed that lead for over 8 hours conducting
numerous interviews with subjects associated with Marcus. Contact was
again made with Marcus who continued to state that he had been shot
during a drive by shooting. Marcus later changed his story stating he
was attempting to buy Marijuana from an unknown male when that male shot
him in the leg.
Upon conclusion of this investigation it was discovered that Marcus
was in possession of a firearm while he was heavily intoxicated. At one
point Marcus was placing the firearm in his pants pocket when he induced
a negligent discharge into his leg. Doctors described the bullet wound
as entering his upper leg and traveling strait down his leg towards his
knee. This evidence supported the finding that Marcus had caused his
own injury and he in fact fabricated all of the stories out of
embarrassment.
